Open Question: Is it illegal to take out a small loan for a down payment on a car that will be financed from a diff. bank?

I will be getting an auto loan from one bank to cover the cost of a car, a 2006 Chevrolet Cobalt SS, but the person who was supposed to make my down payment for me backed out. Would it be illegal or represented as fraud if a small loan of $1000 or $2000 was taken out to cover a down payment on a car, but paid back in 2 months? If so what would an option be for obtaining money for a down payment?
